Arbitration is a procedure held in an attempt to resolve an issue out of court. This “mini-trial” is held in the presence of an impartial third party, known as an arbitrator. The arbitrator may be one, or more than one person. Both the disputing parties get an equal opportunity to present their evidence and testimony in the hearing, after which the arbitrator issues its decision. The decision is usually final and is rarely re-examined by court. Arbitration has its own specific set of rules, and the procedure is much faster and less formal than that of a court, besides being less expensive. Arbitrators are usually retired judges or respected lawyers.
Mediation, on the other hand, is an out-of-court settlement of a dispute by an independent person. This person, called the mediator, is a neutral third party, who meets with the opposing sides and helps them find a mutually satisfactory solution. Unlike a courtroom judge or an arbitrator, a mediator has no power to impose a decision. His/her only job is to bring the disputing parties to an amicable agreement. The mediator is usually a professional lawyer well versed in all legal aspects of the case.
